These Terms of Use ("Terms") govern your access to and use of the Bilagon platform, including any content, functionality, and services offered on or through the website bilagon.com (the "Platform"). By accessing or using the Platform, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using the Platform.
By using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms or the Privacy Policy, you must not use the Platform.
You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

By submitting User Content, you grant Bilagon a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, copy, reproduce, process, adapt, publish, transmit, display, and distribute such User Content in any and all media or distribution methods.

You agree not to engage in any of the following prohibited activities:
9.1. Bilagon may terminate or suspend your account and access to the Platform at its sole discretion, without prior notice or liability, for any reason, including if you breach these Terms.
9.2. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10.1. The Platform is provided on an "as is" and "as available" basis. Bilagon makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, or materials included on the Platform.
10.2. To the maximum extent permitted by law, Bilagon disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Bilagon does not warrant that the Platform, its servers, or emails sent from Bilagon are free of viruses or other harmful components.
10.3. To the maximum extent permitted by law, Bilagon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the Platform; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Platform; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Platform by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Platform; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
You agree to defend, indemnify, and hold harmless Bilagon, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from (i) your use of and access to the Platform; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Platform.
12.1. These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered by [Arbitration Institution] in accordance with its [Arbitration Rules]. Bilagon reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
14.1. Entire Agreement: These Terms constitute the entire agreement between you and Bilagon regarding the use of the Platform and supersede any prior agreements between you and Bilagon.
14.2. Waiver and Severability: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Bilagon's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in effect.
14.3. Assignment: These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Bilagon without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.
14.4. Notices: All notices required or permitted under these Terms shall be in writing and shall be deemed given when delivered in person, sent by email, or mailed by registered or certified mail, postage prepaid, to the addresses specified by the parties.
